Terms of Service

By creating an account or using HitZero HQ ("Service", "we", "us"), you agree to these Terms. If you are accepting on behalf of an organization (a gym or business), you represent that you have authority to bind that organization.

HitZero HQ is currently in a limited beta. Features, pricing, and availability may change. We will provide reasonable notice of material changes. During the beta period, the Service is provided with limited warranties — see Section 8.

You are responsible for maintaining the security of your account credentials. You must notify us promptly at hello@hitzerohq.com if you believe your account has been compromised. We may suspend accounts that violate these Terms.

The Service is intended for gym owners, coaches, and administrative staff aged 18 or older. Athlete profiles may be created for minors by authorized gym staff and parents.

You agree not to:

• Use the Service for any unlawful purpose
• Upload or transmit harmful, fraudulent, or misleading content
• Attempt to access systems or data you are not authorized to access
• Resell or sublicense access to the Service without written permission
• Use the Service to compete with HitZero HQ

Platform subscription: HitZero HQ charges gym owners a monthly platform fee. Subscription billing is handled through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. You may cancel at any time through the billing portal; cancellation takes effect at the end of the current billing period.

Stripe Connect (parent payments): If you use HitZero HQ to collect tuition or fees from parents, those payments flow through your gym's Stripe Connect account. HitZero HQ takes a 1.25% platform fee on parent payments processed through Stripe Connect. Stripe's standard processing fees (2.9% + 30¢ per transaction) apply separately and are the gym's responsibility.

Free tier: The free tier is provided at no charge and may have capacity limits. We reserve the right to modify free tier limits with 30 days notice.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect and handle data including athlete information and parent contact details.

You retain ownership of all gym data you upload to the Service. You grant HitZero HQ a limited license to store, process, and display that data solely to provide the Service.

The HitZero HQ platform, software, and content are owned by HitZero HQ and its licensors. These Terms do not grant you any right to use our trademarks, logos, or brand features without prior written consent.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HITZERO HQ'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) $100. WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

Either party may terminate your account at any time. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination to allow export, then delete it.

We may update these Terms. We will notify you by email or in-app notice at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.

These Terms are governed by the laws of the United States. Any disputes will be resolved by binding arbitration under the American Arbitration Association rules, except that either party may seek injunctive relief in court for intellectual property violations.
